How Long Will My Case Last?

There are many variables which may affect the settlement process.  For instance, negotiations generally cannot begin until medical treatment is completed because, until then, the amount of damages cannot be established. However, most cases can be settled, and many cases are settled without filing a lawsuit.  A settlement is a compromise, and both sides will have their own reasons for settling.  Remember that going to trial is no guarantee that you will receive anything.  The experienced personal injury attorney should be able to advise the client on the probable range of outcome if the case were to be tried, what the risks of trial are, and the range of acceptable settlement amounts.  The attorney cannot make the decision to settle without the client’s consent.  Settlement agreements are final, and you will be required to sign a release that ends the claim permanently.

 

What is My Claim Worth?

Some injuries are relatively easy to demonstrate and quantify.  Many others, like emotional distress or soft tissue injuries, are not.  It is the attorney’s job to prove the nature and extent of a client’s damages, and work with the client to place a dollar value on them.  Evaluating a case is not an exact science, and the amount you can collect may also be limited by the insurance coverage of the defendant.  Some things, like medical expenses you have incurred and wages you have lost, are relatively easy to understand and calculate.  If the injuries are severe, however, future medical costs and future lost income – perhaps for the rest of a person’s life – have to be estimated.  In addition to these monetary losses, the law provides that an injured person is permitted to recover a reasonable amount for pain, suffering, scarring, and other intangible damages.  In all areas of the calculation of damages, the defense will generally argue that the amounts are not as much as you say, or that your damages ought to be reduced for some other reason, such as that they claim you are partly responsible for your own injury.  A knowledgeable and experienced personal injury attorney should assist in valuing your claim.
