Pedestrian injury is the second leading cause of unintentional injury-related death among children ages five to 14.  Adults, however, are also frequently pedestrian victims.  In Arizona, the pedestrian has the right of way only at marked or unmarked crosswalks.  An unmarked crosswalk is at any intersection.  Elsewhere, pedestrians may still cross the roadway if they observe three principles.  First, a pedestrian must watch for approaching traffic.  Second, a pedestrian must yield to approaching traffic at any place other than a marked or unmarked crosswalk.  And third, a pedestrian must cross directly across the roadway in a line perpendicular to the two sides of the roadway.  Jay-walking is walking in a “catty-corner” manner, not directly across the roadway.  Although a pedestrian may not be entitled to the right of way, he may still be able to recover a portion of his damages if the motorist was inattentive.
