Begam & Marks Settles Death Claims for Daughters

When the retirement living center's van transporting residents on their weekly shopping trip came to an abrupt halt at a red light, a resident's electric wheelchair overturned, fracturing her pelvis. Tragically, this injury, superimposed on her already compromised health, took the woman's life a few days later. This van had recently replaced a newer, better equipped van. The woman's surviving daughters came to Begam & Marks to find out why their mother was injured and to hold those at fault responsible.

Begam & Marks attorneys Steven Friedman and Serena Montague found that the van in use the day of the injury did not have sufficient straps to secure all of the wheelchairs being transported. In fact the driver, when this van replaced an earlier van, had complained to management about the van's lack of restraints. When he received no response to his complaints, the driver had "jury rigged" some restraints, using straps he removed from another vehicle. However, there were not enough to secure Mom's chair.

The Begam & Marks team that represented Mom's two surviving adult daughters convinced the living center's insurance carrier to settle the claim for a significant sum. This legacy will help the surviving daughters, who were devastated by Mom's early death, raise their own children - a tribute to the grandma the children will now never know.
